Legal Disclaimer for Aglobaltowing

1. Limitation of Liability:

Aglobaltowing shall not be liable for any damages, losses, or expenses arising from or related to our towing services, except in cases of gross negligence or willful misconduct on our part. This includes, but is not limited to, damages to vehicles, personal property, or consequential damages. We are not responsible for pre-existing damage to vehicles.

2. Vehicle Condition:

We are not responsible for the condition of any vehicle towed by us, including but not limited to mechanical failures, electrical issues, or damage to contents within the vehicle. Customers are advised to remove all personal belongings from their vehicles prior to towing.

3. Impound and Storage:

Aglobaltowing is not responsible for any fees or charges incurred at impound or storage facilities. Customers are responsible for all impound and storage fees, as well as any related administrative costs.

4. Authorization:

By requesting our services, you represent and warrant that you are the legal owner of the vehicle or have the authority to authorize the towing of the vehicle. You agree to indemnify and hold harmless Aglobaltowing from any claims or liabilities arising from unauthorized towing.

5. Payment:

Payment for services rendered is due upon completion of the tow, unless otherwise agreed upon in writing. We reserve the right to refuse service or withhold a vehicle until payment is received.

6. Changes to Terms:

Aglobaltowing reserves the right to modify or amend these terms and conditions at any time without prior notice.

7. Governing Law:

This agreement shall be governed by and construed in accordance with the laws of the State of Denver, without regard to its conflict of law principles. Any dispute arising out of or related to this agreement shall be subject to the exclusive jurisdiction of the courts located in Denver Colorado

8. Force Majeure:

Aglobaltowing shall not be liable for any failure or delay in performing its obligations under this agreement due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government regulations.  

9. Release of Liability:

By utilizing the services of Aglobaltowing, you hereby release, waive, and discharge Aglobaltowing, its officers, employees, and agents from any and all claims, demands, actions, or causes of action arising out of or related to our towing services.

10. Customer Responsibility:

The customer is responsible for ensuring that the vehicle is properly prepared for towing. This includes, but is not limited to, disengaging the parking brake, placing the vehicle in neutral, and ensuring that all loose items are secured.

11. Disclaimer of Warranties:

Aglobaltowing provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, reliability, or suitability of our services.  

Refund Policy - the basics

At Aglobaltowing, we strive to provide reliable and professional towing services. We understand that sometimes situations may arise where a refund is requested. This policy outlines our guidelines for refund requests.

Eligibility for Refunds:

Refunds may be considered in the following circumstances:

  • Service Not Performed: If you were charged for a service that was not performed due to our error or cancellation by us, you are eligible for a full refund.

  • Overcharging: If you were charged an amount exceeding the agreed-upon price or our published rates, the overcharged amount will be refunded.

  • Significant Damage Caused by Our Negligence: If our towing service caused significant damage to your vehicle due to our negligence, a refund for the towing portion of the service may be considered, in addition to addressing the damage itself. (This is subject to investigation and verification).

  • Pre-Payment Cancellation: If you have pre-paid for a scheduled service and cancel with sufficient notice, as defined in our cancellation policy, you may be eligible for a partial or full refund.

Non-Refundable Circumstances:

Refunds will not be granted in the following situations:

  • Customer Cancellation Without Sufficient Notice: If you cancel a service without providing adequate notice, as specified in our cancellation policy, you will not be eligible for a refund.

  • Service Performed as Requested: If the towing service was performed as requested and agreed upon, refunds will not be issued due to dissatisfaction with the location or other factors outside of our control.

  • Damage Pre-Existing the Tow: We are not responsible for damage that existed prior to the towing service.

  • Impound Fees: Impound fees are set by the impound lot and are not refundable by Aglobaltowing.

  • Services rendered where the customer changed their mind after the service was completed.

Refund Request Procedure:

To request a refund, please follow these steps:

  1. Contact Us: Contact our customer service department at +1 303-618-2140 or within 7 days of the service date.

  2. Provide Information: Provide the following information:

    • Your name and contact information

    • The date and time of the service

    • The vehicle's make, model, and license plate number

    • A detailed explanation of the reason for your refund request

    • Any supporting documentation, such as receipts, photos, or videos

  3. Investigation: We will investigate your request and may require additional information.

  4. Decision: We will notify you of our decision within [Number] business days.

  5. Refund Processing: If your refund is approved, it will be processed within 14 business days using the original payment method.

Cancellation Policy:

 Cancellations made less than 1 hour before the scheduled service time will incur a cancellation fee of $30.
